Excise Tax Rate Change Effective July 1, 2013
The California gas tax is going up to 39.5-cents per gallon, an increase of 3.5 cents per gallon, but the State Board of Equalization (BOE) says the rate hike really won’t increase prices.
The motor fuel tax on on-road diesel remains at 10-cents per gallon, same as last year.

On Tuesday, Nov. 4 2012, the U.S. Supreme Court came close to almost laughing out of court a lawsuit brought by environmentalists against the Los Angeles County Flood Control District. The National Resources Defense Council (NRDC) wanted the Flood Control District to crack down on each of the 1,400 rainwater pollution dischargers into the San Gabriel and Los Angeles Rivers.

After 35 years of employment, and many years of disagreement over research on air pollution and its implications for environmental regulations, Dr. James E. Enstrom, assisted by the American Center for Law and Justice, filed a federal lawsuit against various University of California and UCLA administrators in June 2012.
Enstrom’s complaint alleged that UCLA had refused to reappoint him after he engaged in successful whistleblowing against a member of the Department of Environmental Health Sciences. Last week, a federal district court issued an encouraging ruling in Enstrom’s case. On March 18, United States District Judge Jesus G. Bernal signed an order denying some defendants’ motions to dismiss Enstrom’s First Amendment retaliation claims.

San Diego, CA – Cleaire Advanced Emission Controls announced today that the California Air Resources Board (CARB) has approved an expansion of the previously verified Vista® diesel particulate filter to cover a broad range of 1993 and newer model year engines. In particular, the verified control group include later model EGR and Caterpillar ACERT engines.
Effective November 15, 2012, the CARB verification expansion allows the Vista to be installed on 1993 through 2010 model year engines from 2.7 to 13 liters having a power range of 100 to 450 Horsepower.

A state plan to rank communities by the cumulative effects of pollution on residents has raised objections among local business leaders, who say it would kill job development in areas identified as disadvantaged.
The proposed California Communities Environmental Health Screening Tool would use existing environmental, health and socioeconomic data to score areas by ZIP code. It would take into consideration such factors as ozone pollution, traffic density, pesticide use, the number of hazardous waste dumps and cleanup sites, cancer and asthma rates, and the number of seniors and children.

Great Basin Unified Air Pollution Control District tells CARB to - “Back-Off”
In a letter dated July 5, 2012 (received 7-12-12) and sent to various top-ranking individuals at CARB, the Great Basin Unified Air Pollution Control District (GBUAPCD) Board asked CARB to reconsider its diesel rules and the adverse financial effect on small-businesses and government agencies all for no meaningful improvement in district air quality. The letter, signed by Theodore Schade, Air Pollution Control Officer for the district stated, “Diesel emissions are not a meaningful component of the air quality problems we face.” Diesel emissions account for less than 5% of the total PM2.5 inventory in California that CARB is controlling through draconian regulations focused at diesel truck and equipment owners.

This notice is a reminder of several new labeling requirements for in-use off-road diesel vehicles. By January 1, 2013, BOTH sides of all vehicles subject to the Off-Road Regulation must be labeled with the equipment identification number (EIN).
Additionally, the EIN labels on vehicles owned by captive attainment area fleets must be changed to white on a green background by January 1, 2013. Because captive attainment area fleets are potentially subject to lesser compliance requirements than those fleets operating in surrounding areas, the labels on vehicles owned by captive attainment area fleets must be changed in order to differentiate them from other vehicles not eligible for this provision. Captive Attainment Area Fleets are fleets or fleet portions in which all of the vehicles operate exclusively within the following counties:

Change may be the only constant in the real world but that doesn't seem to include the Scientific Review Panel.
Don't fret if you've never heard of it. It's one of those obscure governmental "no-see-ums" that do their business in relative anonymity and by the time you figure out you've been stung, you're left swatting at empty air.
It was the Scientific Review Panel that first declared PM2.5 (tiny particulate matter made up of dust and soot) in diesel exhaust a dangerous air contaminant in 1998.
Next thing you know -- ZAP! -- the California Air Resources Board cooked up the truck and bus rules that are costing operators hundreds of thousands of dollars as they're forced to buy expensive filtration equipment or replace their fleets entirely in the next few years. |

No state environmental body takes as much pride in its national and international influence as does the California Air Resources Board.
That power and influence, however, may be drawing some heat from the DC Beltway.
U.S. Rep. Peter DeFazio, D-OR, requested that the Subcommittee on Highways and Transit examine two CARB truck emission rules during a hearing. In a letter to Subcommittee Chairman John J. Duncan, R-TN, DeFazio asked Duncan to schedule a hearing to examine CARB’s On-Road Heavy-Duty Diesel Vehicles (In-Use) regulation, and the Heavy-Duty Vehicle Greenhouse Gas Emission Reduction regulation.

ARB provided a two-month extension from the original January 31, 2012, reporting deadline to give fleet owners more time to submit their information before widespread enforcement of the regulation begins.

SACRAMENTO - The California Air Resources Board is now offering a lease-to-own financing opportunity that encourages small business owners to replace their older diesel trucks with clean new equipment.
The objective of this program is to encourage early compliance with ARB’s on-road diesel vehicle and tractor-trailer greenhouse gas regulations.
“This is a program that benefits small fleets and owner-operators,” said ARB Chairman Mary D. Nichols. “It provides them with an additional way to pay for a cleaner truck, even if their credit isn’t stellar.”

No, that's not a real word, but you'll be using it too by the time you finish reading this tale about the California Air Resources Board, Harris Ranch and a cowardly act of terrorism.
Oh, I should clarify: The cowardly act of terrorism was done by true criminals, as opposed to CARB, which isn't technically a crime syndicate but, as I've reported before, often employs a legal form of intimidation to achieve its ends. More on that in a bit.
Gotta have your background first.
The state gives truckers grants to replace old, polluting trucks with newer, cleaner burning ones.
That's just the carrot. There's a stick, too -- a big one.

CARB in a recent email to our legal counsel’s office purports to clarify CCTA’s role in the labeling requirements for the low-mileage construction truck extension. Over the last month, we requested a follow-up with CARB concerning some confusion about CCTA’s role.
We have clarified that “CCTA does not appear to have a direct role in the label process,” and CCTA may voluntarily assist its members if desired (i.e. print decals, etc.). The email clarifies that CCTA has no mandatory role in this process. As such, each individual company must determine how best to comply with the CT labeling requirements required under subdivision (p), paragraph (2) of the rule, set out below:

I’ve been hearing much about whether or not older trucks need an engine emission control label (ECL) that is in conformance with CARB regulations, Section 2183(c).
Please read this CARB Advisory below. It should answer all your questions.
I have also heard that OOIDA is fielding calls from their members that CARB will not allow (through DMV vehicle registrations) trucks that are re-powered with an engine older than the original. The exact language is, “engine switches (are allowed) as long as the resulting vehicle matches exactly to any certified configuration of the same or newer model year as the chassis.”
Attached is the relevant EPA “guidance” [EngSwitch] on the subject – 21 years old. According to our read, a member in California who has a 2000 MY truck engine and re-powers with a 1998 engine (same OEM and engine family, same HP) may be in trouble. While the engine has exactly the same emissions profile as the original 2000 engine under the hood it is not the same or newer model year as the chassis. We could see if they had an 04, 07, or ’10 (all new technology year changes) and replaced with an older engine how that could be an issue. What’s ironic about all of this is that for ‘94 or older (engine) owners don’t even need to report and can operate until the end of 2014, ‘95 & ‘96 till the end of 2015! Bet there’s a demand for 95 & 96’s!!!!

In a move that could reshape the American automobile industry, California regulators Thursday are expected to approve sweeping new rules requiring that 15 percent of new cars sold in California by 2025 run on electricity, hydrogen or other systems producing little or no smog.
The regulations by the California Air Resources Board, dubbed the "advanced clean car rules," would start in 2018, ramping up each year and ultimately resulting in 1.4 million "zero emission" vehicles on California roads by 2025. Today there are only about 10,000 such vehicles in the state.
"This is a really large step. It's transformational," said Tom Cackette, an engineer and chief deputy director of the air board. "Ten years from now the market is going to look quite a bit different."

Reporting Extended to March 30, 2012

Over the last four weeks CIAQC has focused much attention on CARB and the On-Road Truck Regulation. On December 16th CIAQC meet with CARB staff in Sacramento to discuss several significant implementation issues for the Truck & Bus Regulation and testify at the CARB Board Hearing---the staff met with us prior to our Board testimony in the “CIAQC Office” in the cafeteria. This followed the December 6, 2011 CIAQC letter to Governor Brown outlining the detailed concerns including retrofit filter safety, and the numerous problems with the ability of fleets to register their trucks using CARB’s on-line reporting system along with and CARB’s lack of outreach on the implementation of the regulation and tight deadlines that were emerging.

Occupational and population-based studies have related exposure to fine particulate air pollution, and specifically particulate matter from vehicle exhausts, to cardiovascular diseases and lung cancer.
Objectives
We have established a large retrospective cohort to assess mortality in the unionized U.S. trucking industry. To provide insight into mortality patterns associated with job-specific exposures, we examined rates of cause-specific mortality compared with the general U.S. population.
